Terms and Agreements
Information:
In the event of malfunction, loss, or damage, the Customer must contact Party Event Machines and speak to an employee. Failure to do so will result in no refund being issued. While we strive to assist, we may not always be available to troubleshoot, and most issues are related to power (see "Power" below).
Power:
The machine(s) require a 110-volt, 20 amp dedicated circuit with no extension cord. The machine will not function properly with inadequate power. It is the Customer's responsibility to ensure that sufficient power is available at the event location before signing the contract. If the machine(s) do not function due to insufficient power, the full contract amount will be charged, and a $50 machine test fee may be applied.
Cleaning:
The Customer is responsible for returning the machine(s) clean. General cleaning instructions are provided. A minimum cleaning fee of $35 applies to all machines. NOTE: Do not disassemble the machine for cleaning; any damage resulting from disassembly will incur repair costs. Machines should be cleaned thoroughly without disassembly.
Hot Weather:
If temperatures exceed 80 degrees, we cannot guarantee that the machines will freeze properly when used outdoors. In such conditions, move the machines to a cool indoor space to ensure proper freezing.
Machine Performance:
If a machine fails to work at your event, it will be tested upon return to our office. If the machine functions correctly during our testing, no refund will be issued. This policy is strictly enforced.
Property Ownership:
The Customer acquires no title, interest, or lien on the machine(s). Ownership remains with Party Event Machines, and the Customer agrees to keep the machine(s) in good working order.
Responsibility:
Machines are rented on an “as is” basis. The Customer assumes full financial responsibility for any damage to the equipment while in their possession.
Liability:
Machines must be kept upright at all times. The Customer is liable for any damage caused by improper transportation. If a machine is returned on its side or back, a minimum $50 fee will be charged for testing. Frozen drink machines contain freon refrigerant and must not be laid horizontally. Party Event Machines is not liable for any damages resulting from the use of the machine, including but not limited to property damage, personal injury, or any other incidents. The Customer assumes full responsibility for all liabilities associated with the use of the rented equipment. By renting from Party Event Machines, the Customer agrees that no legal action or suit can be held against Party Event Machines for any damages or injuries that occur as a result of using our equipment.
Transportation:
Machines must be transported in a pickup truck or SUV. We do not allow machines to be placed on car seat upholstery.
Fees:
All fees are charged at the time of booking and are non-refundable within 10 days of the rental date.
Missing Items:
A minimum fee of $25 will be charged for each rental item not returned.
Deliveries:
Pickup time is firm. If an employee must wait or return at your convenience, a $50 fee may be charged. Delivery is based on a one-person bid. Incomplete or inaccurate site information may result in additional delivery costs. We do not deliver up or down stairs or onto step-up patios. Deliveries are made on flat surfaces at the garage area.
Delivery Fee:
For deliveries within Santa Clara County (within a 50-mile radius), the delivery fee is $100 round trip. An additional $50 fee applies for each extra 50 miles. Tolls and parking fees will be charged separately.
Equipment:
Do not disassemble any equipment without first consulting a Party Event Machines Customer Service Representative. Disassembly may result in serious injury and/or equipment damage, for which you will be liable.
Collections:
All costs associated with collecting on this contract will be added to the current outstanding balance. An interest rate of 18% per annum will be applied to the outstanding balance monthly.
Products:
The Customer agrees to use product mixes approved by Party Event Machines for the specific rental(s) on the contract. Using unapproved product mixes in rented machine(s) will make the Customer liable for any resulting damage.
